Immigration court documents were filed by the department in late October in the case of a domestic violence victim from Guatemala whose case has been unresolved for 14 years. The officials made a clear recommendation that the applicant, Rody Alvarado, be granted asylum. Though a decision from the immigration appeals court judge is still necessary, the government’s assent will surely be a significant factor in the judge’s decision. This recommendation paves the way for similar asylum claims in the future and has offered important guidance in an otherwise uncertain area of immigration law.
